Surat: Court orders husband, who claimed to be unemployed, to pay ₹10,000 in maintenance for wife he abandoned

 

The family court in Bardoli, Surat district, has ordered a husband who concealed his income and abandoned his wife to pay ₹10,000 in monthly maintenance. The court also directed him to pay an additional ₹6,000 for application expenses.

According to the case, the victim, a resident of Bardoli, was married in 2003 to a man from Mumbai. Initially, the couple's life was normal, but later, the husband and his in-laws allegedly began to harass her. The victim alleged that she was subjected to mental and physical torture, faced demands for dowry, and was ultimately expelled from the house in 2021.

According to her, the husband did not provide sufficient funds for her expenses, even though he was involved in the hotel and brokerage business. Subsequently, the woman filed a petition for maintenance in the Bardoli court, which was later transferred to the Bardoli family court. During the hearing, the husband claimed to be unemployed and asserted that he had no income.

However, evidence presented by the wife revealed that the husband was involved in real estate brokerage and had sufficient sources of income. The court stated in its ruling that the evidence clearly indicated that the husband had mentally and physically tortured the wife and failed to provide maintenance despite having adequate means. Garhvi directed the husband to pay ₹10,000 in maintenance to the wife every month from the date of the application. Advocate Preeti Jignesh Joshi represented the victim in this case. The court's decision is being regarded as a significant ruling in cases of domestic violence and abandonment.
