Court Denies Anticipatory Bail to Three Accused in Vadodara Brick Dealer Attack
Businessman assaulted and robbed of Rs 1.52 lakh in cash
Vadodara: The court has rejected the anticipatory bail applications of three individuals accused of attacking a brick dealer on Gorwa Undera Road on March 28th. Kashim Khan Irfan Khan Mohd., Kesar Khan Abrar Khan Pathan, and Ghulamnabi Nabi Mohd. Pathan have been wanted for this crime for the past 25 days.
The incident involved six assailants traveling in two cars, who stopped the businessman's car, pulled him out, injured him severely, and looted Rs 1.52 lakh in cash. Other accused are also believed to be involved in the attack.
During the hearing in the sessions court, both the petitioner's and government's advocates presented their arguments. After examining the evidence, 8th Additional Sessions Judge Rajendra H. Prajapati pronounced the verdict. The decision took into consideration the officer's affidavit, which detailed the assault on the complainant, causing grievous injuries, including fractures to his hands and feet, and the robbery of Rs 1.52 lakh.
The petitioner's active role in the commission of the offense and involvement of other accused led the judge to deem the anticipatory bail application unacceptable and unjustified. It was also noted that granting anticipatory bail could lead to tampering with the prosecution's evidence, as the crime appears to be a well-planned conspiracy.
The petitioners claimed they had been wrongly implicated due to personal enmity with the complainant, who allegedly has multiple offenses registered against him. However, the ongoing investigation and multiple offenses registered against the complainant are not grounds for granting anticipatory bail.
