Pune, June 30. A new legal dispute has emerged in the Ketan Agarwal murder case.
Advocate Ashutosh Srivastava, claiming to be the lawyer for the accused Sia Goyal, has sent a legal notice for 10 crores to Sia's brother Sahil Goyal. The notice alleges that Sahil Goyal made false, misleading, and defamatory statements against them in front of the media, causing serious damage to their professional image and reputation. The legal notice states that Sia Goyal formally appointed him as her legal representative by signing a power of attorney.
This appointment was not made based on any verbal claim, media publicity, or without authority, but was based on legal permission given by an adult accused of her own volition. According to the notice, the original signed power of attorney has already been filed in the competent court, and other original documents will be presented before the relevant Manch or court if necessary. The notice claims that Advocate Ashutosh Srivastava's power of attorney has been accepted and recorded by the Vadgaon Maval Court.
Despite this, Sahil Goyal publicly questioned their appointment without verifying legal documents and without any discussion with the lawyer. The notice states that it is extremely shocking and unfortunate that Sahil Goyal made a statement in the media without confirming the validity of the power of attorney, claiming that he was not appointed or authorized by the family. Advocate Ashutosh Srivastava states that Sahil Goyal's statements have sent a wrong message among people that he attempted to falsely claim to be the lawyer of the accused or intervened in the case without authority.
The notice demands that Sahil Goyal immediately retract his alleged defamatory statements, publicly apologize unconditionally, and provide written assurance that such allegations will not be made again in the future. The notice also warns that if a satisfactory response is not received within the stipulated time frame, Advocate Ashutosh Srivastava will take appropriate legal action against him, including a civil suit for 10 crores for defamation and damage to reputation. This dispute began on Monday before the hearing in the case court, when Sahil Goyal questioned Advocate Ashutosh Srivastava's appointment in a media interaction, stating that the family never appointed him as their lawyer.
He also alleged that it is possible that Ashutosh Srivastava obtained Sia Goyal's signatures fraudulently. Sahil Goyal's statement came at a time when Advocate Ashutosh Srivastava was presenting himself as Sia Goyal's lawyer on several media platforms, responding to issues related to the case. However, Sahil Goyal clearly stated that the family did not appoint Advocate Ashutosh Srivastava as their lawyer.
The family has appointed Advocate Vipul Dushing as their lawyer. He also claimed that the family has already filed an affidavit in court regarding this matter.
Additionally, Sahil alleged that threats were also made to their family by Advocate Ashutosh Srivastava. This new dispute arising in the Ketan Agarwal murder case now appears to be taking the form of a separate legal battle between the accused's family and the lawyer claiming to represent them.
