Surat Family Court Grants Divorce to Husband in Case Involving Wife’s Extramarital Affair and Child from Another Man
Surat – In a sensitive matrimonial case, the Surat Family Court has ruled in favor of the husband, granting divorce on the grounds of the wife’s extramarital affair and the birth of a child with another man. The court, after thoroughly examining all facts and evidence, concluded that the continuation of the marital relationship was no longer viable.
Rajesh (name changed), a resident of the Vesu area, married Asha (name changed) in 2009. Initially, their married life appeared normal, and the couple had a son. Asha began living with Rajesh’s joint family after marriage, but over time her behavior reportedly changed.
According to the husband’s petition, Asha began instigating frequent arguments and pressured him to become a ghar jamai (live-in son-in-law). She and her family allegedly issued threats to falsely implicate Rajesh and his relatives in a dowry case. Despite the tension, Rajesh tried to preserve the marriage and eventually agreed to live with Asha at her family home from 2011.
Later, Rajesh discovered that Asha was involved in an illicit relationship with one Vijay Soni. Rather than addressing his concerns, Asha allegedly expelled him from the house and filed false allegations against him in court. It subsequently came to light that Asha had given birth to a son with Vijay Soni, whose name was listed as the father in the birth certificate, with Asha Soni mentioned as the mother.
Asha refused to accept maintenance from Rajesh without providing any justifiable reason and began living with Vijay Soni independently. Following these developments, Rajesh filed a divorce petition in the Surat Family Court through his legal representative, Advocate Preeti Jignesh Joshi.
Presiding over the case, Additional Principal Judge A.S. Desai observed that the wife had acknowledged the child born from her extramarital affair, which was a direct breach of marital trust. The court held that such circumstances rendered the marital bond unsustainable and ruled in favor of granting divorce to the petitioner.
Advocate Preeti Jignesh Joshi represented the husband and presented the case effectively, ensuring all facts were clearly demonstrated before the court.
