New Delhi, Feb 13 (IANS) Bollywood actor Jacqueline Fernandez has withdrawn from a Delhi court her plea which had sought directions to restrain alleged conman Sukesh Chandrashekhar from issuing any letters related to her to the media.

"Main application is disposed of as withdrawn, which is the prayer in the present application. Thus, nothing survives in the application and stands disposed of accordingly," Additional Sessions Judge Chander Jit Singh's order read.

Chandrashekhar is a prime accused in a Rs 200 crore extortion case.

He was writing letters to the media, through which Jacqueline had said that certain unwarranted statements outraging her modesty had been made by him.

"This is an attempt by the main accused Sukesh Chandrashekhar to somehow intimidate and threaten the present applicant so that she does not reveal the truth to the court in the capacity of a prosecution witness," her application had read.

The actor had stressed on the distress caused by the "unsolicited dissemination" of these letters to the media, citing concerns for her safety and well-being.

"Sukesh Chandrashekhar persistently engages in the unsolicited dissemination of troubling letters to numerous electronic and print media platforms. These letters, once published by the media outlets, create an alarming and distressing environment for the applicant," Jacqueline had claimed.

She had further said that letters' widespread publication amplifies the intimidation and harassment, profoundly affecting her safety and well-being.

The plea had specifically named the Superintendent of Mandoli prison and Delhi Police's Economic Offences Wing, urging them to prevent further communication from Chandrashekhar.

Jacqueline had prayed to the court to issue directions to the probe agency and the Superintendent of Jail, Mandoli, to immediately restrain/refrain Chandrashekhar from issuing any further letters, messages, or statements addressed to her directly or indirectly.

New Delhi, Dec 25 (IANS) After Bollywood actor Jacqueline Fernandez moved a Delhi court seeking immediate direction to restrain alleged conman Sukesh Chandrashekhar from issuing any letters related to her to the media, the latter has filed an application saying that he is entitled to write letters to friends, family, relations and legal advisors.

“I am also covered by Right to Express and Freedom of Speech, even though I am incarcerated as per the law and the Constitution,” read Chandrashekhar’s application, confirmed by his counsel advocate Anant Malik.

Jacqueline's application, which is listed for hearing on January 17, seeks orders preventing the dissemination of letters, statements, or messages about the actor by Chandrashekhar.

Chandrashekhar, the prime accused in a Rs 200 crore extortion case who is currently lodged in Mandoli Jail, has been writing letters to the media, on which Jacqueline has said that certain unwarranted statements outraging her modesty have been made by him.

Chandrshekhar’s application says he has written multiple letters to Jacqueline from 2022 till date, but she did not raise any such complaint in the whole of 2022, and the half of 2023, as they were serving her purpose.

Chandrashekhar has alleged that now the reason to sensationalise this issue by using the court as a platform by her is because she has moved an application before the Delhi High Court seeking quashing of the ECIR, and wants to establish a fact of having nothing to do with him (Chandrashekhar), in the pendency of her application in the HC.

The ECIR Chandrashekhar is referring to is Jacqueline seeking to quash a money laundering case registered against her by the Enforcement DIrectorate.

She has challenged the ED's complaint and the second supplementary charge sheet dated August 17, 2022 under Sections 3 and 4 of the Prevention of Money Laundering Act, 2002.

Notably, the Economics Offences Wing (EOW) in its reply to Jacqueline's application on his letters has said that it was a matter of grave concern that an important ‘witness’ in the case was harassed and threatened by the accused, and that it could affect the trial.

On this, Chandrashekhar’s counsel had earlier said: “It is rather surprising that she has been treated as a ‘witness’ in the state matter as individuals with a much less role than her in the entire controversy are languishing in judicial custody for the past 28 months, while she has been let off scot-free by the EOW despite the3 ED bringing on record solid evidence against her and her involvement with Sukesh Chandrashekhar.

"It is the ED's case that she had absolute knowledge about the antecedents of Sukesh Chandrashekhar and still was involved with him."

Chandrashekhar had called the EOW’s investigation biased.

Malik had said: “Thus the important question to be adjudicated is why the EOW has not made Jacqueline an accused in the case when there existed cogent evidence in the ED charge sheet against her and her role being much more than the other co accused in the case."

In his freshly filed application, Chandrashekhar contends about Jacqueline mentioning herself as a prime prosecution ‘witness’ in the EOW case, and has said that it is important to note that she is an ‘accused’ in the related PMLA case.

“The applicant was first made an accused by the ED and thereafter the EOW surprisingly and selectively makes her a witness in their case, whereas other co-accused who are on a similar footing have been made accused,” Chandrshekhar said.

He alleged that during police custody, Fernandez had on multiple occasions requested him to give statements to protect her interest, and respect in the society.

“On the relationship front, it's an admitted fact from the applicant’s (Jacqueline) side, and also in her statements before the ED and EOW, which are on record," the application read.

On Jacqueline being the witness or an accused, Chandrashekhar says, "Her role as a witness in the EOW case is very limited and it's not the fact that the case in 208/21 EOW stands only due to the testimony of Jacqueline, for which I am desperate to establish contact with her to withhold any truth in the criminal trial as alleged by her in the present application."

Chandrashekhar further claims that Jacqueline herself was constantly seeking favours from him directly as well as through their common friends, with regard to the ED case in which she is an accused.

“The applicant is equally liable to be arrayed as on accused in the EOW case also, as her statement mentioning she was conned, targeted, cheated, and was not aware of my alleged antecedents is completely wrong.

"As per proven record and the charge sheet of ED, there is evidence to show that in February 2021, her associate Shaan sent her media links related to my ongoing case and prison term,” the application read.

“Irrespective of all the said facts, she decided to continue her relationship with me till the day of my arrest in the present case, and even visited me multiple times when I was released on interim custody bail. All these facts are part of the judicial record,” it added.

Reiterating his point from earlier press statements issued, Chandrashehar says that EOW mysteriously does a bias probe and makes her a witness in the case.

“If the applicant was truthful about having mental intimidation because of the letters, she should have approached the Hon’ble Court in 2022 itself when multiple letters were sent by me to her, giving her moral support in my best capacity emotionally, not selectively raising issues just because some application is filed by the applicant in the ED case,” he says.

He also prays for the court to hear him before passing any orders on Jacqueline's application.

New Delhi, Dec 18 (IANS) Bollywood actress Jacqueline Fernandez has submitted a petition in the Delhi High Court seeking to quash a money laundering case registered against her by the Enforcement Directorate (ED).

She has challenged the ED's complaint and the second supplementary charge sheet dated August 17, 2022 under Sections 3 and 4 of the Prevention of Money Laundering Act, 2002.

The petitioner asserted that the evidence presented by the ED will establish her innocence, portraying her as a victim of alleged conman Sukesh Chandrashekhar's targeted attack.

The petition strongly denies any involvement on her part in aiding Chandrashekhar to launder allegedly ill-gotten wealth.

Fernandez argued that she should not be prosecuted under Sections 3 and 4 of the Prevention of Money Laundering Act.

The ED had filed its second supplementary charge sheet naming her as an accused. Fernandez and another Bollywood personality, Nora Fatehi, have recorded their statements as witnesses in the case.

Earlier, assets and fixed deposits worth Rs 7.2 crore belonging to Fernandez were attached by the ED, which termed these gifts and properties as "proceeds" of crime received by the actor.

In February, the ED had filed its first supplementary charge sheet against Pinky Irani, an alleged aide of Chandrashekhar, who introduced him to Bollywood actors.

It had been alleged in the charge sheet that Pinky used to choose expensive gifts for Fernandez and drop them at her residence after Chandrashekhar made the payments.

In December 2021, the probe agency had filed the first charge sheet in this matter.

As per official sources, Chandrashekhar has spent around Rs 20 crore on different models and Bollywood celebrities. A few had, however, refused to accept gifts from him.

New Delhi, Oct 14 (IANS) In yet another love letter, alleged conman Sukesh Chandrashekhar has expressed his admiration for Bollywood actress Jacqueline Fernandez and praised her for recent appearance at the 'Doha Show.'

Chandrashekhar, who is lodged in Mandoli jail in the national capital, begins the letter by showering Jacqueline with compliments, praising her beauty and expressing admiration for her recent appearance at the 'Doha Show.'

"Baby firstly you were looking super hot and pretty at the ‘Doha Show’. Baby there is no one prettier than you, my Bomma," he writes.

As the Navratri festival approaches, Chandrashekhar expresses his intentions to fast for the entire nine days "for actress well-being" and to dispel negativity surrounding their lives. He attributes their future success to divine intervention, stating, "With Ma Shakthi's divine intervention, everything will be only in our favour, and the truth will prevail."

Chandrashekhar goes on to assure Jacqueline of their impending togetherness, saying, "We will be with each other very soon, come what may and live together forever, my Baby girl."

In a notable gesture, he reveals plans for a special pooja and aarti at the Maa Vaishno Devi Temple and Mahakaleshwar Temple on the ninth day, with both their names. 

He expresses confidence in their imminent triumph and suggests that their detractors will soon face a reckoning.

"Baby trust me, we are gonna have the last laugh as all those who have laughed, underestimated, and been judgmental about you and me are gonna have no face to show very soon as the time has come for the moment of truth," Chandrashekhar states.

He concludes the letter with a promise of unwavering support and protection for Jacqueline, emphasising his love and dedication: "Baby no 'cage' in this world can stop me from loving you and protecting you and standing up for you. Baby, I know how much you love me, at the same time you know my baby, I live for you, I would kill for you, I would die for you.” 

New Delhi, Oct 4 (IANS) Alleged conman Sukesh Chandrashekhar has sent a legal notice to popular singer-composer Mika Singh over his comment on actress Jacqueline Fernandez's Instagram photo featuring herself with Hollywood actor Jean-Claude Van Damme, best known for his martial arts action films.

Recently, Mika's comment on the pic, which read, "You are looking so beautiful.., he is much better than #sukesh..," quickly drew widespread attention before the singer deleted it.

“Your statement has triggered extensive public discourse about our client's character and personality, subjecting him to a de facto trial by media. This situation is exacerbating his existing distress and poses significant challenges due to relentless media scrutiny,” read the notice sent by Sukesh’s lawyer Anant Malik. 

“Our client is a man of repute and enjoys goodwill in the Indian film industry, various business houses and political circles. He holds goodwill and reputation both nationally and at a global level. You yourself being a member of the Bollywood industry are is very well aware of the struggles one faces to build his/her name in this field. However, your comment has not only tarnished our client's image but has also adversely affected his personal and professional life,” it added. 

“It is further being made clear to you that such vilification is a deliberate, desperate act on your part to malign and tarnish the reputation of our client, and our client will not tolerate such behaviour. You are, therefore, put to notice that by your derogatory comment, you have committed serious criminal offence of defamation, and are therefore liable to be prosecuted, inter-alia, under the provisions of Sections 499/500 of the Indian Penal Code, 1860,” the notice said.

“It is pertinent to mention that defamation is a criminal offence punishable with jail term of up to two years. Further, you are also notified that your statement is also an infringement of our client’s personality rights which is guaranteed under Article 21 of the Constitution. 

“You (Mika) are further directed to immediately issue an unconditional apology to our client, cease and desist from making any further false, scurrilous, defamatory and disparaging statements, and causing any further harassment to our client,” it added. 

New Delhi, Aug 11 (IANS) In yet another love letter, incarcerated alleged conman Sukesh Chandrashekhar has wished Bollywood actress Jacqueline Fernandez on her birthday on Friday, promising her of celebrating together in the future.

Addressing the actress as his "baby girl", Chandrashekhar, who is currently lodged at Delhi's Mandoli jail, wrote: "Wishing you a very Happy Birthday. May God bless you, my Baby Girl. Your Birthday is the happiest day of every year in my life. In fact, it means more to me than my own birthday. You are becoming even more beautiful and youthful with each passing day. I am missing you immensely; you have no idea." 

The letter was released through his lawyer Anant Malik on Friday morning.

"I miss the moments of gifting you exotic flowers and, most importantly, our magical hugs, and sharing cake. Baby, I truly hope you like my birthday gift. I understand that no material possessions like gold, diamonds, or pearls can bring you more happiness than realizing your dream of building shelters for animals," he further wrote.

It however, remains to be seen what the "birthday gift" is .

Chandrashekhar also included a handmade greeting card with the note: "Baby, the attached greeting has been crafted by my own hands. I have captured a few significant memories that I miss on this beautiful day of yours. All this turbulence is on the brink of conclusion, my dear.

"Next year, we will celebrate your birthday together, and I promise to make it exceptionally special. The world will surely envy. Baby, my Bomma, you're a superstar and profoundly special. You are the best thing that has ever happened in my life. Cherish this day, wear only that lovely smile. Don't fret about anything else; I am here for you… Happy Birthday, my Bomma, My Honeybee."

New Delhi, March 25 (IANS) A Delhi court on Saturday adjourned actress Nora Fatehi's plea against Jacqueline Fernandez alleging that the latter made defamatory allegations against her for "malicious reasons" and to destroy her career in Rs 200 crore extortion case involving conman Sukesh Chandrashekar as the prime accused, for May 22.

The matter was listed before Metropolitan Magistrate (MM) Kapil Gupta of Patiala House Court.

On January 13, Fatehi had recorded her statement as a witness in the money laundering case in the presence of Metropolitan Magistrate Akriti Mahendru.

The court had, on December 19, 2022, noted that counsel for the complainant sought some time to file the list of witnesses.

Fernandez is also being investigated by the Economic Offences Wing (EOW) of the Delhi Police in the case involving Chandrashekhar.

Earlier, Fatehi had also appeared before the EOW.

She has alleged that Fernandez made a false statement against her despite being an actress too.

"Fernandez has unnecessarily dragged and defamed me as I am in the same industry. She is fully aware that the business of any artiste and their career is solely based on their reputation. This clearly establishes that the said imputation has been made with the intention and knowledge that such imputation will harm the reputation of the complainant," her plea read.

She had also accused a few media firms for quoting Fernandez, which lowered her reputation, in the same plea.
